Solar carports in France: prior declaration or building permit?

Since late 2024, French carports are no longer treated as ordinary buildings. The regime depends mainly on the project’s capacity and location.

The rule since 1 December 2024

For applications filed from 1 December 2024, planning rules for solar carports were aligned with those for ground-mounted plants. Outside heritage-protected areas, a prior declaration applies up to 3 MWp and a building permit above it. The threshold used to be 1 MWp.

What to check locally

  • The local plan (PLU): height, setbacks, appearance, parking rules.
  • Heritage and landscape protection: it changes the procedure and the architectural bar.
  • Coastal law: in coastal municipalities, recent case law treats a carport as an extension of urban development, which must adjoin an existing settlement.
  • Easements: power lines, airports, networks.

Building a strong application

Location plan, site plan, sections, landscape integration and a written notice: for a carport, integration often decides the outcome. A slender structure with few supports and a continuous roofline is easier to defend before planning officers or heritage architects than a forest of columns. Typically one month for a prior declaration and two to three months for a building permit, longer in protected areas.

Does the APER obligation replace planning consent?

No. The duty to add solar does not replace planning consent: the project must still be declared or permitted.
